CINCINNATI — The U.S. Court of Appeals for the 6th Circuit ruled Friday in favor of Julea Ward, an Eastern Michigan University graduate student represented by Alliance Defense Fund attorneys who was expelled from a counseling program for her beliefs. In a strongly worded opinion, the court reversed a district court decision in favor of the university and sent the case back for trial, saying “a reasonable jury could conclude that Ward’s professors ejected her from the counseling program because of hostility toward her speech and faith….”

Washington is 22-47 against the spread its last 69 games as an underdog. The Wizards are 5-21 against the spread their last 26 games following a straight-up win of more than 10 points. Houston is 7-3 against the spread its last 10 games as the betting favorite. The Rockets are also 16-7 against the spread their last 23 games following a point spread loss. Summertime is usually when TV networks air repeats of shows we've already seen. In his State of the Union Address Tuesday night, the president got a five-month jump on the summer season by re-running a class-envy video he has broadcast more times than local stations have shown episodes of "The Andy Griffith Show."
Instead of a credible assessment of the state of the union, which is not good, the president delivered a slightly toned down campaign speech. We heard more of the same about how "the rich" aren't paying their "fair share" in taxes.

Drop-Out Laws Hard to Enforce President Barack Obama in his State of the Union speech called on states to refuse to let students drop out earlier than age 18. The Columbus Dispatch reports that in Ohio, drop-out regulations are difficult to enforce because few students actually use the official process for dropping out at age 16 -- they just quit showing up at school.
DeWine Says Drilling Laws 'Not Adequate' Attorney General Mike DeWine said his research into hydraulic fracturing regulations indicates Ohio should institute stronger penalties for violating regulations and require more disclosure of chemicals used in the process, The Vindicator reports.
Right-to-Work Law Looms in Nearby Indiana With Indiana's House paving the way for a right-to-work law in that state, Republican officials in other Midwestern states say they're feeling pressure to seek similar laws to be able to compete, The New York Times reports.

When Republican presidential candidate Mitt Romney casually estimated that his effective tax rate is around 15 percent, progressives immediately pounced on the issue. To this ideological minority with its Ahab-like obsession on class warfare, a rich American paying an effective tax rate of “only” 15 percent is, a priori, a scandal of the first order.
Yes, this story is a scandal (actually, a series of scandals) but not the one that progressives think it is.
